1.
The Hotel Stay Sweepstakes (“sweepstakes”) is a thank you for
your (a.k.a “the Donner” )(hereafter known as “you”; “entrant”; or “Donner”)
contribution(s) to the Little People of America 2009 National Conference in NYC
(herein know as “LPA NYC 2009”) and in no way as any legal agreement,
partnership, or contract be formed by such entry.
2.
The contribution specified by you on the contribution form for
the amount(s) of either $10 (which entitle you to one entry into the
sweepstakes) or $25 (which entitle you to three entries into the sweepstakes)
shall be used by LPA NYC 2009 as deemed necessary for cost incurred for this
sweepstakes and/or the cost for hosting the LPA 2009 National Conference in
NYC.

Donations can be made either through mail (using the donation
form) or on-line at www.lpanyc2009.org under the specific item for donation for
entry into the sweepstakes.
4.
Each Donner can make multiple donations (in the amounts
specified above) which will entitle you to multiple entries (as specified
above) into the sweepstakes. Each $10 or $25 donation must be separate.
Contributions made in excess of the $25 donation on a single mailed donation
form will be honored as a single donation and will entitle you to the maximum
number of entries (three) into the sweepstakes.
5.
Donation for entry into the sweepstakes received after the
deadline set forth in the contest announcement are ineligible, null, and void
for entry into the sweepstakes. LPA NYC 2009 will not be responsible for and
will not consider incomplete or incorrect entries. It is your responsibility to
fill out all information required on the donation form. LPA NYC 2009 is not
responsible for entries that are sent but not received by LPA NYC 2009 for any
reason. Donations made to LPA NYC 2009 without specific reference to the
sweepstakes shall be considered contributions made by you that do not require
entry into the sweepstakes.
6.
One (1) First Prize, One (1) Second Prize and One (1) Third
Prize will be awarded based on random drawing (“Sweepstakes”) from all entries
received by LPA NYC 2009. Odds of winner are based on number of entries. In
contests in which winners are picked at random, the odds of winning depend upon
the number of entries received and cannot be determined in advance.
7.
To redeem any prize the winner must be registered for the LPA
2009 National Conference in NYC.
8.
Winner(s) will be notified via phone call to the telephone
number provided by you after the drawing. Up to 2 attempts will be made to
contact the winner(s) via telephone contact with the 1st attempt
being made the day after the drawing and 2nd attempt 3 days after
the first attempt date. A final attempt will be made to contact the winner(s)
via e-mail that is provided with your donation.
If the winner does not respond to the notification within five (5)
business days, another winner will be chosen. Failure to respond within five
(5) business days shall mean that the winner forfeits the prize.
9.
All content or information (collectively and severally,
"Materials") submitted by you (the donor) to LPA AND LPA NYC 2009
shall become the sole and exclusive property of LPA AND LPA NYC 2009, and LPA
AND LPA NYC 2009 shall have no obligation to preserve, return, or otherwise
make available to you or others any Materials.
10. By
making the donation you agree to hold Little People of America (“LPA”), LPA NYC
2009 and its officers, directors, employees, agents, successors, volunteers and
assigns harmless from and against—and hereby waive any right to pursue—any
claims of any nature arising in connection with LPA AND LPA NYC 2009's use of
the Materials submitted to LPA AND LPA NYC 2009 and used in any manner in LPA
AND LPA NYC 2009's sole and absolute discretion.
11. All
entrants and winners must be at least 18 years of age, unless otherwise stated
or posted.
12. Winners
may not request substitutions of prize winnings. All winners are solely
responsible for any and all taxes and/or fees as well as all additional costs
that may be incurred.
13. Neither
LPA AND LPA NYC 2009 nor its officers, directors, employees, agents, successors,
or assigns shall be liable for any warranty, costs, damage, injury, or any
other claims incurred as a result of the usage of a prize by any winner. LPA
AND LPA NYC 2009 is not liable for any loss arising out of or in connection
with any contest promoted by LPA AND LPA NYC 2009.
14. If the
specified prize becomes unavailable for any reason, LPA AND LPA NYC 2009 in its
sole and absolute discretion may substitute a prize of like or equal value.
15. LPA
NYC 2009 reserves the right in its sole and absolute discretion to terminate
any contest at any time without prior notice.
16. LPA
AND LPA NYC 2009 reserves the right in its sole and absolute discretion to
alter any contest rules at any time.
17. By
making you donation or contribution to LPA NYC 2009, you conclusively are
deemed to have agreed to be bound by these contest rules and terms and
conditions as well as by any rules specific to such contest. This is an
irrevocable condition of entry. Failure to agree to all the terms and
conditions specified herein for this sweepstakes does not guarantee return of
any donation made by you for entry into this sweepstakes. All donations are
made free and clear by you from any obligation for LPA NYC 2009 or entry into
such sweepstakes.
18. Each
contest will state a deadline for entry and the date when the winner(s) will be
announced. A list of winner(s) may be obtained by sending a self-addressed,
stamped (first-class postage) envelope to LPA NYC 2009 and requesting the list.
19. LPA
NYC 2009 reserves the right to condition the award of prizes upon the execution
by the winner(s) of a publicity release. Notwithstanding this reserved right,
entry is conclusively deemed to be permission by the entrant to use the
entrant's name (without compensation to the entrant) if the entrant is a winner
to publicize the contest and otherwise, as determined by LPA NYC 2009, unless
prohibited by law.
20. LPA
NYC 2009 reserves the right to require the winner to execute an affidavit of
eligibility as a sworn document and provide other proof of eligibility as a
condition of receipt of the prize or award.
